This Privacy Policy provides information about how Sunrider Manufacturing, L.P. (“TXP”) collects, uses, shares and transfers information relating to individuals (“Personal Information”), and information about your rights and choices regarding our processing of your Personal Information. A reference to “TXP”, “we,” “us,” or “our” is a reference to Sunrider Manufacturing and any affiliate involved in the Personal Information processing activity.

This Privacy Policy applies to all visitors to our websites https://sunridermanufacturing.com referred to herein as the “Site”)), to online services provided by us or our affiliates that contain a link to this Privacy Policy, and to any form of communication between you and us (collectively referred to as the “Services”). Please read this Privacy Policy carefully. By interacting with the Site or otherwise providing your Personal Information and other information through our Services, you agree that we may collect, use, share and/or transfer that information in accordance with the terms and conditions of this Privacy Policy, subject to your rights and our obligations under applicable law. You also acknowledge and agree to be bound by all of the terms and conditions in the Site’s Terms of Use, which are fully incorporated herein by this reference.  

This Policy may apply to Personal Information relating to employees, job applicants, and contractors, who will also be provided a separate Privacy Statement from TXP where required by law.

Sunrider Manufacturing, located at 3201 Challenger Drive Midlothian, TX 76065, is the controller of your Personal Information as described in this Privacy Policy, unless stated otherwise.

  1. INFORMATION TXP COLLECTS
    1. Personal Information Collected From You

When you submit an online application (and/or other employment-related documents, such as a résumé) for one or more potential job employment, TXP collects the following Personal Information from you:

  • Name (first, middle, and last);
  • E-mail address;
  • Present and Permanent Addresses;
  • Phone number and Cell Phone Number;
  • Date of Birth;
  • Legal status to work in U.S.;
  • Sex;
  • Desire employment (such as position, commencement date, and desired salary);
  • Prior/former employers (such as name, address, start date, end date, job titles, name and title of supervisor, and reason for separation);
  • Education (including name of schools, address, years attended, and other pertinent information);
  • Military Service;
  • References (including reference name, address, phone number, and years acquainted).

If you would like TXP to track and record your usage on its websites, you must OPT-IN to it. This function is automatically disabled, and will only be turned on if you request it. The purpose of this function is strictly customer service oriented and used in order to help you navigate our websites. Any information related to this service will be deleted after 30 calendar days. If you opt-in, TXP collects the following Personal Information from you:

  • Your web browser name, version, and build platform for the browser used to access our websites;
  • Your device hardware IP address, hardware name, and operating system version for the device used to access our websites. 

If you have opted into the web tracking services, you can turn these tracking services on and off whenever you like by going to your Account page and changing your preferences.

We may combine the Personal Information that we have collected about you with other information about you obtained from other sources (both online and offline), such as from third parties and public sources. If you provide us, our service providers, or our affiliates with any Personal Information relating to other individuals, you represent that you have the authority to do so, and where required, have obtained the necessary consent, and acknowledge that such Personal Information may be used in accordance with this Privacy Policy.

  1. Website Use & Navigation Information

TXP collects the following information when you visit our Site:

  • Collection of Visitor Information

TXP stores the Internet Protocol address, the time and date of entry, and the specific pages viewed by each visitor to the Site. 

We use third-party web analytics software, such as Google Analytics and Google Tag Manager, in connection with our Sites. Web Analytics software helps us understand how visitors interact with the Site, how we can further improve the user experience, and how we can attract new customers. Information collected through these means may include, without limitation, web browsers used to access our Sites, the length of visits to certain Site pages, and page response times.

TXP also contracts with third party advertising networks that collect IP addresses and other information from pixel tags or web beacons on our Site, in our emails, and on third party websites. These networks use cookies and other device and usage data in order to recognize individuals who have previously visited a particular website. This information is used to measure advertising effectiveness and provide advertisements about our products or services tailored to your interests. 

We may use social media plug-ins from companies like Youtube, Facebook, or Twitter, on our Site to enable you to easily share information with others. We may also use the information collected from the plug-ins, such as your demographic data and marketing or product preferences, to learn about your interests and better serve you. These plug-ins may allow social media companies to receive Personal Information about you and your visit to our Site through the placement of cookies on your computer.  This enables companies to recognize you on websites belonging to them, their affiliates, and their partners, and to use information collected from your visit to our Site to supplement information about your prior activity on those websites.  The plug-ins collect such information about users regardless of whether they specifically interact with the plug-in.  

TXP does not control what information is collected by the social media plug-ins, or whether the social media companies share this information with other users. We encourage you to refer to the privacy statements on the social media company websites for more information on social plug-ins.

  1. HOW TXP USES THE INFORMATION WE COLLECT

This section describes the business purposes for which TXP uses the Personal Information we collect. Please note that there may be other uses, which we would describe to you when we collect the information.

  1. TXP will process your Personal Information for the following purposes:
    • Communicating with you, in the context of recruitment activities, such as:
      1. to obtain additional information where necessary, 
      2. to inform you of available vacancies, and 
      3. to provide you with information about your application and fulfill your request where necessary.
    • Managing recruitment and employment resourcing activities, including activities related to organizational planning in the course of recruitment activities, we may use your information:
      1. to set up and conduct interviews and assessments, 
      2. to evaluate, select, and hire applicants, 
      3. to conduct background and credit checks and assessments as required or permitted by applicable local laws, 
      4. to contact third-party references provided b you to evaluate your previous performances, and/or 
      5. as other necessary in the context of recruitment activities.

We may use or disclose your Personal Information when we have your consent to do so, including when you opt in to receiving certain communications where required under applicable law. If we are using your Personal Information based on this ground, you may withdraw your consent at any time by contacting us using the contact information below.

  1. Compliance with legal obligations

TXP may use or disclose your PersonaI Information when necessary to: 

  • Comply with a court order, subpoena, or warrant; 
  • Comply with the request of a government agency or regulatory body
  • Collect monies owed to TXP;
  • Investigate activities that TXP believes in good faith are unlawful;
  • Enforce or apply our Terms of Use; or
  • Protect the rights, property, and safety of third parties and TXP. 
  1. HOW TXP SHARES INFORMATION WE COLLECT

Except as otherwise stated in this Privacy Policy, we do not sell, trade, or rent your Personal Information.  TXP does not share your information with any third parties for their direct marketing purposes. 

We may share or disclose your Personal Information (including all categories of Personal Information collected as described in Section I above) for a business purpose with third parties, including affiliates, agents, vendors, or service providers who assist us in the process of providing products or services to you, or otherwise perform functions on our behalf. These third parties use your Personal Information only at our direction.

We reserve the right to disclose your Personal Information if permitted or required by law, or in response to a law enforcement or other legal request and/or to comply with a judicial proceeding, court order, or legal process. We also may disclose your Personal Information if we believe such disclosure is reasonably necessary to protect or defend our interests or the interests of our users or as necessary to protect the public from harm. If we sell or transfer a business unit or asset to another company or enter into a strategic business transaction, we may share your Personal Information with parties to the transaction to disclose our assets, respond to due diligence requests, or for other purposes to facilitate the business transaction.

We may share aggregated data with third parties collectively in an anonymous way, which does not reveal Personal Information. In addition, we may share your Personal Information with a third party at your request, or if you consent to the disclosure.

If you do not wish to receive marketing information from us, you may opt out by: (1) declining marketing information when registering or at other information gathering points on the Sites, or (2) informing us that you no longer wish to receive marketing communications by emailing us at privacy@sunrider.com. We will comply with these requests except with respect to communications required by law or contract, or that do not require your consent under applicable laws.

  1. Accessing, Correcting or Deleting Your Personal Information

You have the right to access, correct, or delete your Personal Information, where provided for under and subject to applicable data protection laws. To exercise these rights, please use the Change Profile page on the Site, or contact TXP using one of the following contact methods:

If you request deletion of your Personal Information, TXP may keep some of your information on file for business and legal reasons as permitted under applicable law.

We use commercially reasonable administrative, physical and technical measures intended to safeguard your Personal Information and help protect it from unauthorized access or loss. Unfortunately, no data transmission over the Internet is 100% secure, and while TXP makes every effort to protect your personal information, TXP cannot guarantee its complete security. TXP makes no assurances about our ability to prevent any loss, misuse, or alteration of the information that TXP obtains from you, and TXP will have no liability to you or to any third party arising out of any such loss, misuse, or alteration. Because security is as important to TXP as it is to you, TXP will continue to search for and implement security measures in order to protect the security of your personal information.

  1. User Name, and Password

Your user name, and password are specific to you and must be safeguarded by you. You accept sole responsibility for all use of the Site conducted with your user name, and password. TXP strongly advises that you change your password frequently. 

  1. Stolen or Lost Information

You must promptly notify TXP via email at info@sunrider.com if you suspect that your user name, and/or password has been lost, stolen, or used without your permission. After receiving your notification, TXP will remove or reset that user name, and/or password from your account and update its records accordingly. 

  1. INTERNATIONAL TRANSFERS

Any Personal Information you provide to TXP, and that TXP shares with affiliates, agents, vendors and service providers, may be stored and processed, transferred between and accessed from the United States and other countries, which may not guarantee the same level of protection of Personal Information as the country in which you reside. However, we will handle Personal Information collected through the Site and other means in accordance with this Privacy Policy, and in compliance with applicable law.

  1. LINKS TO OTHER WEBSITES

In order to provide information to users, we may provide links to or compatibility with other websites or applications. We are not responsible for the privacy practices employed by those websites or the information or content they contain. To the extent you access a third-party website, the privacy policy of that other website will apply to your access of that site. We encourage our users to read the privacy statements of other websites before proceeding to use them.

  1. DATA RETENTION

We may retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and as outlined in this Privacy Policy. We will keep your Personal Information for periods of time needed to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements, and otherwise as permitted by law. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide Services to you; (ii) whether there is a legal obligation to which we are subject; or (iii) whether retention is advisable in light of our legal position (such as in regard to the enforcement of applicable Terms of Use, applicable statutes of limitations, litigation or regulatory investigations)

  1. CHILDREN’S PRIVACY PROTECTION

The Site is a general audience site that is not specifically designed or targeted at children. TXP does not knowingly collect, use, or disclose personally identifiable information about visitors under 18 years of age. As such, TXP does not sell or share Personal Information of consumers under 18 years of age. By accessing our Sites or initiating any communication with us, you represent that you are at least 18 years old.

  1. CHANGES TO PRIVACY POLICY

TXP reserves the right to change this Policy at any time. TXP will post any changes to this Policy with their effective dates. If TXP makes material changes to this Policy, TXP may also communicate them by email or conventional mail. You acknowledge and agree that it is your responsibility to update TXP with your current contact information, review this Site and this Policy periodically, and to be aware of any modifications. You can update your information on the Change Profile page on the Site. Your continued use of the Site after any modifications will constitute your acknowledgment of the modified Policy and your agreement to be bound by it. 

  1. INTERPRETATION

The original text of this Policy is in English and any interpretation of it will be based on the original English text. In the event of a conflict between different translations of this Policy or any documents or notices related thereto, the original English version will prevail.
